General terms and conditions for online sales

Art. 1 – General provisions
These conditions govern the online sale of products offered by Luis T. S.r.l., with legal office in Bolzano (BZ), Werner von Siemens Str., 18 – Tax code 02274840210 – Bolzano Company register no. 167343 and hereinafter referred to as ‘Luis Trenker’, on the brand’s official website and the and premium.luistrenker websites.

These conditions may be subject to changes and the date shown below is the date they were drawn up and published on the website and the date of their commencement.

The current conditions apply exclusively to purchases made on the official website and on the websites in accordance with the provisions of Chapter I, Title III, Part III of the Consumer Code, Legislative Decree no. 206/2005 amended by the Legislative Decree no. 21/2014 and no. 70/2003 on e-commerce.

Art. 2 – Pre-contractual Terms and Conditions
Before the purchase contract is concluded through confirmation of the order with the “Proceed with Payment” the customer has been informed:
- of the total price of the goods including taxes with shipping costs and any other costs specified;
- of the chosen payment method;
- of the time limit in which Luis Trenker undertakes to deliver the goods;
- of the existence of the legal guarantee of conformity for the goods purchased.
- of the conditions, time limit and the procedures for exercising the right of withdrawal (Article 13 of these terms and conditions) as well as the withdrawal form set out in Annex I, part B of the Legislative Decree 21/2014;
- of the returns policy.

Art. 3 – Purpose of the contract
These general terms and conditions govern the sale by Luis Trenker of the products shown and offered for sale on the official, and on the and websites.
When you proceed with the purchase process on the respective websites you accept the general terms and conditions of sale and the data protection policies indicated therein (insert link connecting to privacy policy) that are adopted by Luis T. S.r.l as data controller.
Before visiting the products supplied on the site, the user (from now on called ‘customer’) is required to read the current general terms and conditions provided by Luis Trenker, which are understood to be generally and unambiguously accepted at the time of purchase.
In the order confirmation email the customer will also receive the link to download and archive a copy of these general terms and conditions of sale pursuant to Article 51 paragraph 1 of the Legislative Decree 206/2005 amended by the Legislative Decree 21/2014.

Art. 4 – Products Offered
The moveable goods marketed by Luis Trenker consist of clothing, furnishings and home accessories.

The offer is listed on the, and websites.
Before concluding the purchase contract, the customer can view the characteristics of the goods illustrated in the website’s dedicated areas prior to their selection.

Art. 5 – Conclusion and Effectiveness of the Contract
The contract can only be concluded on the internet when the customer enters the area – accessible both from the website and the and websites – and completes a purchase order following the website’s procedure.
There are two methods for completing purchase:

1. 1. Order without registration: To conclude the purchase contract in this case the electronic form must be completed and forwarded in accordance with the instructions given.
2. 2. Order with registration: In this case the customer must register in the dedicated area, follow the instructions and subsequently log in to enter the purchase area.
Before the contract is concluded the client declares they have read and accepted the general terms and conditions of sale, viewed the image of each product and taken note of its price, the possible means of payment, the shipping methods for purchased products, the relative costs of shipping and delivery and read the conditions for the rights of withdrawal and the methods and time limits for returning products purchased.
The sales contract will be considered concluded once Luis Trenker sends an email confirming the order. The email contains the customer data and the order number, the price of the goods purchased, the shipping costs, the address the goods will be dispatched to and the link to enable the print-out or saving of these terms and conditions. The customer undertakes to check and verify the correctness of the personal data contained in the confirmation email and to promptly communicate any necessary corrections/amendments.
Payment from the customer is mandatory when the submission of the online order has been concluded. This occurs when the ‘Proceed with Payment’ button is clicked at the end of the guided process.
Once the contract has been concluded, Luis Trenker will process the order.
Luis Trenker undertakes to deliver the goods within 3/4 working days from the date of the confirmation email sent by Luis Trenker.

Art. 6 – Registered Users
When completing the registration procedures, the customer will follow the instructions on the site and provide his/her personal data correctly and truthfully.

When registration is completed, a confirmation email will be sent to the email address supplied by the customer.

Confirmation of the personal data will release Luis Trenker from any responsibility regarding the data provided by the user. The user must promptly inform Luis Trenker of any changes to his/her personal data whenever they are communicated, or amend them personally in the customer profile area.

When the initial activation of the profile is requested, the customer will enter a username and personal password. The customer acknowledges that the above identification data are the validation system for customer access to the service and the only eligible system for his/her identification, therefore actions taken after such access will be attributed to and be binding on the customer. The customer undertakes to keep this access data secret and store them with due care and diligence and not to make them available, even temporarily, to others.

Art. 7 – Product Availability

Product availability refers to the actual availability at the time when the customer makes the order.
Availability must however be considered indicative as products may be sold to other clients before the order confirmation, due to the simultaneous presence of more than one user on the website or as a result of a computer error that permits the purchase of a product that in reality does not exist.
Moreover, even if the confirmation email has been sent by Luis Trenker, a situation where some or all of the goods are unavailable may occur.
If this happens the order will be automatically amended with the elimination of the unavailable product/s and the client will be immediately informed by email and given the possibility to substitute the product with others on offer.
If the customer wishes to cancel the order, terminating the contract, Luis Trenker will refund any amount paid by the customer.
An email will promptly inform the customer of the means and timings of the refund of any payment made.

Art. 8 – Loyalty Program

A loyalty points program is available and called: ‘Carta Premium’.

Points are awarded in the following manner:
- With orders over 1,000 Euro the customer will receive a ‘Carta Premium’ that contains a code;
- To activate and use the loyalty card, the ‘Carta Premium’ must first be registered in the customer’s personal area already set up within the website;
- Once the ‘Carta Premium’ is registered the client will receive a bonus point for every Euro spent;
- The customer will receive a gift when the all bonus points shown in the gift box containing the ‘Carta Premium’ have been collected;
- Furthermore, the registration of the ‘Carta Premium’ entitles the customer to a 10% discount on products purchased online and in the shops;
- Finally the registration of a ‘Carta Premium’ entitles the customer to tailoring services and deliveries free of charge.

The loyalty program also gives the customer the chance to receive information about events organized by Luis Trenker (insert link linked to the privacy policy).

Art. 9 – Payment Methods and Prices

The product price is that indicated below each individual product on the official website at and on the and websites.
The purchase prices of the products shown on the official website and on the and websites are quoted in Euro and inclusive of taxes, but they do not include the shipping costs.
Shipping costs are shown and calculated at the end of the purchase process and before payment has been completed.

Prices may undergo variations at any moment, however any such changes will not affect orders where the order confirmation has already been sent, therefore the goods are invoiced based on the prices indicated on the website when the order is created and shown in the confirmation email sent by Luis Trenker to the customer.

Once selected, the products will be added to the shopping basket, to checkout just follow the purchasing instructions and enter or verify the requested information at each stage of the process. Details of the order can be changed before payment.

Payment can be made using the payment methods indicated on the website which are:
- Credit cards indicated at the time of payment;
- Bank transfer;
- Payment through Paypal
- Payment through ‘Sofortbanking’

Payment can be made for products using gift vouchers and/or discount codes, however these cannot be used to cover shipping costs.

Art. 10 – Delivery

Luis Trenker ships worldwide.
Luis Trenker delivers to the customer’s home address supplied at the time of the order no later than 30 days from the date of the customer’s receipt of the order confirmation email sent by Luis Trenker.

Where an attempt to deliver fails, the order will be sent to the deposit. When this happens the customer will be notified of the order’s whereabouts and how to arrange a new delivery.
If the product purchased cannot be delivered for reasons attributable to the customer, 30 days after the delivery date the contract is understood to be terminated, and therefore Luis Trenker is no longer contractually bound to the customer.

If the product purchased by the customer is lost/destroyed by the carrier, the whole amount will be refunded by Luis Trenker, including the shipping costs but excluding any additional costs.

The shipping costs are to be met by the client and are clearly shown when the order is placed.

Art. 11 – Legal Guarantee of Conformity
Luis Trenker is responsible for any defect on products offered on the websites indicated, this includes the non-compliance of products with articles in accordance with the provisions of Italian law.

In the event defective or non-compliant products are received, the customer has the right to choose between:
1. A replacement, free of charge, with a fully-compliant product of the same type;
2. A credit voucher of the same amount to use for other purchases;
3. The termination of the contract relating to the disputed goods and the consequent refund of its price.

Luis Trenker is very careful about the quality of products offered, therefore the customer may exercise this right by making a claim through the procedure indicated in Article 13 of the terms and conditions of sale.

Art. 12 – Passing of Risk
The risks relative to the product are passed to the customer on delivery of the goods.
Ownership of the products is acquired when full payment has been received, complete with any associated charges – including shipping costs – or on delivery if this occurs at a later date.

Art. 13 – Right of Withdrawal
In compliance with the laws in force, the customer has the right to withdraw without penalty and without specifying a reason within 14 days, starting from the date the product was received.

When the customer requests the right of withdrawal after the fourteenth day, Luis Trenker can request a penalty payment from the customer.
In the case of multiple purchases made by a customer in a single order with separate delivery dates, the 14-day time limit starts from the date of the last product received.
The user who intends to exercise his/her right of withdrawal must promptly inform Luis Trenker in a clear statement, otherwise by sending the form for returns found in Annex I, part B, Legislative Decree 21/2014 shown below.

The right of withdrawal may be exercised by the customer sending a statement or the above form to the email:

Art. 14 – Returning the Goods

In the case when goods are returned, the client is required to return the purchased products within 14 days of the goods’ delivery.
The goods must be sent back to Luis Trenker using the free returns label provided in the confirmation of order dispatch email..
The goods must be returned in perfect condition, in the original packaging, complete of all its parts (including any documentation and accessories) and with the receipt showing taxes attached.
The products must be in a normal state of conservation. The customer’s liability is limited to the decrease in value resulting from anything other than ‘normal’ and necessary handling to verify the qualities, characteristics and function of the goods.

Without prejudice to the right to verify compliance with the above, Luis Trenker will refund the amount paid for the products included in the return, excluding the shipping costs, within 14 days of their dispatch by the client.
In the case of returns, products are shipped by a carrier appointed by Luis Trenker and the cost of return delivery will be met by Luis Trenker for purchases made within the European Union.
In the case a customer uses a different carrier or other means of dispatch, the shipping costs are at his/her expense and Luis Trenker is exonerated from any responsibility regarding the return.
With the exception of Switzerland, the cost of returning products purchased outside the European Union will be paid by the customer (the cost of the return will also include the customs costs that may vary).
The refund is made using the same method of payment selected by the customer during the purchase process, with the exception of payments by credit card.
For payments made using credit cards, the customer must provide Luis Trenker with the necessary banking details to make the refund, entering them on the returns form present in the parcel with the products purchased.

If goods were purchased by gift voucher and/or discount code, the amount will be refunded to the customer with a credit voucher identified by a promotional code that will be sent by email to the client, or, if the return takes place in the retail store, with a voucher given directly to the customer.

The credit vouchers are valid for 1 year.

Art. 15 – Data Processing
Customer data are processed by Luis Trenker in compliance with the current laws regarding the protection of personal data as stipulated in the privacy policy pursuant to Article 13 of the GDPR 679/2016 ( privacy policy link).

Art. 16 – Applicable Law and Jurisdiction
These general terms and conditions of sale are governed by Italian law and interpreted according to it.
Any dispute that is not amicably resolved will be subject to the jurisdiction of the court of the customer's place of residence or domicile, if located in within Italy.
In any case it is also possible to opt for mediation as laid out in the Legislative Decree 28/2010 for the settlement of any dispute arising from the interpretation and application of these terms and conditions of sale by visiting the website (hypertext link).
